Legal obligations
As a host you have not only rights but also obligations. Below are the key legal requirements to keep in mind as a host.
Good Landlord Act (since 2023)
This Dutch law sets rules for fair and transparent renting:
- Written rental contract: You're required to have a written contract
- No discrimination: You may not select based on origin, religion, gender, or other discriminatory grounds
- Transparency: Be honest about costs and conditions
- Point of contact: You must be reachable for your tenant

Permission: check this first
Rental property
Do you live in a rental property? In most cases you'll need permission from your landlord or housing corporation before you can sublet. Check your rental contract and contact your landlord.
Property with mortgage
Have a mortgage? Then inform your mortgage provider. In most cases hospita rental is allowed, but you're obliged to report it.
Homeowners' association (VvE)
Live in an apartment? Check the house rules of the Homeowners' Association (VvE). Some associations have rules about room rental.
Municipal registration
Your tenant must register at your address with the municipality. This is legally required. Good to know: it has no effect on your ownership or tenancy rights.
