Independent – fixed term
A self-contained dwelling (its own entrance, kitchen and bathroom) that you rent out for a fixed term. With this type you agree a set period of 2 years or less.
Important: only under conditions and for specific groups
Since 1 July 2024, permanent (indefinite) rental contracts are once again the norm in the Netherlands. As a landlord you may therefore only use a fixed-term contract in exceptional cases: it is bound by legal conditions and may only be entered into for specific groups of tenants designated by the government: tenants living elsewhere temporarily for study or work, people leaving social shelter or in an emergency housing situation, or renting out during your own temporary absence (see the diplomatic clause below).
If your situation doesn't fall under one of the permitted cases, the contract quickly counts as an indefinite tenancy, with full rent protection for your tenant. So always check up front whether your situation and your tenant qualify. You'll find the current conditions and the full list of eligible groups at the Dutch government (Rijksoverheid).
What this means
- Fixed end date: The contract ends on the agreed date, provided you notify the tenant on time and correctly.
- For temporary situations: Useful when you only want to let the place for a defined period.
The diplomatic clause
Renting out your home temporarily because you'll be staying elsewhere for a while (for work or study abroad, say) and want to move back in afterwards? With this contract type you can include a diplomatic clause.
- It records that the rental is temporary and that you'll reoccupy the property once it ends.
- That way the tenant knows up front that the home must be available again on the end date.
- The clause is based on Article 7:274, paragraph 1(b) in conjunction with paragraph 2 of the Dutch Civil Code, and only applies if you genuinely move back in yourself.
When you choose this contract type, the contract wizard shows the option to add the diplomatic clause, with a short reason for the temporary nature. If you later switch to a different type, the clause is removed automatically.
