Step 1: Notify your tenant on time about the end of the rental period
Unlimited time contract with 9 months probation period (homestay contract)
Do you use the regular homestay contract (unlimited time) with the probation period of 9 months? Notify the tenant before the end of the 9th month. Notify the tenant by a written text message, either by post, mail or a Whatsapp. Make sure the tenant has received your message.
With a cancellation period of maximum 3 months, the maximum rental period with this type of contract (without you losing the right to unilaterally end the contract) is 9 + 3 months = 1 year.
Example 1:
- You want to rent max 6 months;
- Start rent: 1st of January
- Notify tenant: before 1st of April about end of rental period
- Contract ends: 1st of July
Example 2:
- You want to rent max 12 months;
- Start rent: 1st of January
- Notify tenant: before 1st of October about end of rental period
- Contract ends: 1st of January
Do you not want to end the rental period? Be aware that according to the Dutch law the contract will automatically be transformed to a contract for an unlimited period of time. This means the tenant will gain security of tenure and you as a host can no longer terminate the rent without reason. The tenant can always end the rent with a one-month notice period. Limited period of time contract
Do you have a contract for a limited period of time? Notify the tenant 1 to 3 months before the end date.

Step 2: Plan the move-out date
Ask the tenant to inform you about the move-out date or make clear agreements about it together. When all their stuff is moved and the room is clean, you can do an inspection together.
Step 3: Make sure your tenant deregisters
Make sure your tenant deregisters from the municipality and can show you proof of deregistration. The tenant may anonymize part of the information as long as it is clear that it concerns the tenant and your address. When the tenant has moved, the municipality will inform the tax authority. There's no action required on your part regarding this.
Note: Ensure that the tenant deregisters at the municipality themselves. Due to privacy regulations, you as a host may not request data from the municipality or deregister someone. Therefore, Hospi Housing advises including 'deregistration from the municipality' as a condition for the refund of the deposit.

Step 4: Refund the deposit
If the room is left empty and clean, and the tenant is deregistered from the municipality, you can refund the deposit. End the rental period in a manner that you like. Cheers!🥂
