What are the different types of contracts for homestay?

Flexibility is crucial when renting out a room or part of your home. Both hosts and tenants appreciate the option to engage in temporary arrangements.

In general, there are two types of homestay rental contracts:

Rental contract for a set amount of time

This contract is suitable when the duration of the tenant's stay is clear beforehand, which can be anywhere from 2 months to 5 years. The contract automatically ends at the agreed-upon period's conclusion. However, the host is obliged to inform the tenant before this happens. If a new agreement is made with the same tenant after the contract's end, it must be an indefinite contract. Renewing a fixed-term contract with another fixed-term contract is not allowed. The maximum rental period for a shared accommodation is five years, while for a self-contained accommodation, it is two years.

You can still use this type of contract throughout 2023. However, starting from 2024, adjustments will be made to the regulations concerning temporary rental contracts. In most cases, temporary rental contracts will no longer be allowed. Contract for an indefinite period with a 'homestay-clause'

In this type of contract, the first 9 months serve as a trial period, during which the host can end the contract without providing a reason. The tenant has no rental protection during host period. However, the host must give a 3-month notice. After the initial 9 months, the landlord can only end the contract using formal grounds for cancellation (Art. 7:274 BW). In total, the tenant can stay for a maximum of 1 year (9 months trial period plus 3 months notice). After this period, the tenant has rental protection.

Can I easily end the rental contract?

Ending the rental contract depends on the type of contract you chose. For temporary rental contracts, the rental ends after the agreed-upon period. During this period, you can only end the contract with the tenant's approval.

For a contract with a homestay clause', the tenant has no rental protection during the first 9 months, and as a host, you can end the contract without providing a reason. However, there is a maximum 3-month notice period within the first nine months. For the tenant, the notice period ranges from a minimum of one to a maximum of three months, depending on the situation.

Can I extend the rental contract?

If you wish to extend a contract for a set amount of time, it will automatically convert into an indefinite contract. To protect the tenant, the law prohibits renewing a fixed-term contract with another fixed-term contract. However, the host and tenant can mutually agree to adjust the previously agreed-upon period, such as changing it from 6 to 12 months.
